Why Is It Necessary to File an Income Tax Return?

Filing TDS/TCS returns is a statutory requirement in India under the Income Tax Act, 1961. Any person making specified payments as prescribed under the Act is required to deduct tax at source at the time of making such payments and report the same through TDS/TCS returns. However, individuals or Hindu Undivided Families (HUFs) whose books of accounts are not required to be audited are generally not liable to deduct TDS.

Advantages of Filing TDS/TCS Returns

Timely filing of TDS/TCS returns ensures compliance with the Income Tax Act, 1961 and applicable provisions related to prescribed limits and nature of payments. Filing returns on time helps avoid interest, penalties, and disallowance of expenses, thereby ensuring smooth tax compliance and maintaining a clean compliance record.

Disadvantages of Not Filing TDS/TCS Returns

Non-filing or delayed filing of TDS/TCS returns may attract late filing fees under Section 234E and penalties under Section 271H. Additionally, interest may be levied for late deduction or delayed payment of TDS, leading to increased financial and compliance burden.
